General information

These terms and conditions of use (“Terms of Use”) govern access to and use of the website hosted under the domain name (the “Website”) and any of its associated subdomains or web pages – www.mrboho.bg domain name (“Website”) – as well as the content and services that the owner of the website provides to its users (“Users”) and establishes, together with the Privacy Policy and cookies to manage users’ personal data, terms and conditions, who are responsible for the use of the website.

Acceptance

Access to or use of the website or the purchase of any product by Users necessarily and unconditionally implies knowledge and acceptance of these Terms of Use, which users are advised to read carefully before using the products and services offered by Convertika EOOD.

Users under the age of eighteen (18) are prohibited from accessing or using the products and services offered on the Website. By accepting these Terms of Use, Users confirm that they are a natural person with sufficient legal capacity to assume the obligations arising from their actions and that they have read, understood and accepted their contents.

Convertika EOOD reserves the right to change these Terms of Use at any time, in which case the changes will become effective and apply to all users of the website.

When a user violates any of the provisions set forth in these Terms of Use, Convertika Ltd. will notify that user so that the user can remedy the situation, otherwise Convertika Ltd. will reserve the right to cancel or temporarily or permanently suspend that user’s account user.

Convertika EOOD reserves the right to deny access to the offered services to any individual at any time.

Purpose of the contract

These Terms of Use constitute the entire contract governing the terms and conditions for the purchase of products provided to Users by Convertika EOOD on the MR.BOHO.BG site (“Products”).

Purchase of products

  1. How to purchase products

To purchase Products, Users must follow the purchase process set forth on the Website, read and accept these Terms of Use and the Privacy Policy, and select “Complete and Pay” (“Order”). Convertika EOOD will send an email to the User confirming that the order has been accepted (“Delivery Confirmation”). The contract between the User and Convertika EOOD will be formalized after Convertika EOOD sends the user the shipment confirmation. The purpose of the contract will cover only the Products specified in the Order.

  1. Availability of products

All orders are subject to product availability. When a confirmation has been sent, but Convertika EOOD is unable for any reason to provide the requested product, Convertika EOOD will contact the User as soon as possible to inform them of this. In which case, Convertika EOOD can:

(i) offer the User, without a price increase, another product with similar characteristics and specifications to the one initially requested, provided that they meet the User’s needs; and/or

(ii) offer the User to cancel the requested Order and refund the amount paid to the User within a period of (14) business days.

  1. Refusal to proceedan Order

While Convertika Ltd. will do its best to always process all Orders, exceptional circumstances may arise which force it to refuse to process an Order even after it has sent the Shipment Confirmation, therefore Convertika Ltd. reserves the right to make such a refusal at any time and at its discretion.

Convertika Ltd. reserves the right to withdraw any Product from the Website at any time and to remove or change any material or content of the Product without liability to the User or any third party for the withdrawal of any Product from the Website, regardless whether or not this Product has been sold.

  1. Product guarantee

All products presented on the website are supplied by the manufacturer, namely MR. BOHO Spain. All of them come with a two (2) year warranty in accordance with the criteria and conditions described in Royal Legislative Decree, 1/2007, dated November 16, approving the consolidated text of the General Act for the Protection of Consumers and Consumers and other supplementary laws.

Products are deemed to comply with the Terms of Use when they meet all of the requirements set forth below:

(i) They correspond to the description given by MR. BOHO Spain and have the product qualities that MR. BOHO Spain has provided.

(ii) They are fit for use and fit for purpose of Products of the same type.

(iii) They are suitable for any special use required by the User, when he has informed Convertika EOOD about it and provided that MR. BOHO Spain accepts that the product is suitable for this use.

(iv) They have the usual quality and benefits of a product of the same type that the User can expect, given the nature of the product.

When it is proven that the product does not meet the established specifications, Convertika EOOD will proceed, when appropriate, to repair or replace the Product, reduce the price of the Product or cancel the contract for its purchase; such arrangements will have no cost to the consumer.

Convertika EOOD is not responsible for any damage to the Products that may result from their improper use or from actions or inactions of the User that do not meet the specifications of each Product, or for damage caused by unrelated third parties with Convertika EOOD and MR. BOHO Spain.

Convertika EOOD pays great attention to the presentation and description of the products. However, product images are for illustrative purposes only. To discover the exact features of each product, users should check the relevant descriptive details that accompany each product.

  1. Product delivery

Once the delivery confirmation has been sent, the products will be delivered to the address specified by the user when placing the order, within a period of two (2) to approximately fourteen (14) days from the time they leave Convertika Ltd.

If the product is marked “Available for pre-sale” when selected and added to cart, delivery may take up to 25 days.

Convertika EOOD does not assume any responsibility or liability when the Product is not delivered because the data provided by the User is incorrect or incomplete, or when the delivery cannot be made due to the fault of the transport company designated for these purposes.

Delivery times are approximate, although Convertika EOOD does its best to meet them.

  1. Product price and payment

The applicable prices for each Product are those published on the Website on the date the User places the Order. While Convertika EOOD makes every effort to ensure that all prices on the website are correct, errors may occur. When Convertika Ltd. discovers an error in the prices of any of the products that the user has requested, it will inform that user as soon as possible and give him the opportunity to reconfirm the order at the correct price or cancel it. When Convertika EOOD cannot contact the User, the Order will be considered canceled and the User will be fully reimbursed for the amounts paid by him.

Convertika EOOD is not obliged by law to supply the user with any product at a price below the correct one (even when the delivery confirmation has been sent) if the error in the price is obvious and unequivocal and the user could reasonably expect to recognize it as incorrect price.

Prices are subject to change at any time. However, possible changes will not affect products for which Convertika EOOD has already sent order confirmations.

  1. a) Method of payment

Users can pay by credit or debit card Visa, Visa Electron, Mastercard, etc. In order to minimize the risk of unauthorized access, the User’s credit card details will be encrypted.

  1. b) Value Added Tax (VAT)

The applicable VAT is the legally valid rate at any time depending on the specific product.

  1. Chargeback

When a chargeback occurs, under no circumstances does Convertika EOOD bear the costs resulting from this chargeback. The user accordingly declares that he will bear these costs or penalties.

Return and exchange of products

  1. a) Right of withdrawal

According to the applicable regulations, when the User enters into a contract as a consumer, he can withdraw from the contract (except in certain cases established by law) and freely return or exchange a delivered Product at any time within a period of fourteen (14) calendar days from the date the Product was delivered (“Withdrawal Period”).

After the Product has been checked that it corresponds and meets the requirements established in section c) of the General Terms and Conditions “Product Delivery” and when the User does not decide to make a replacement, Convertika EOOD will refund the User the amount he paid for the Product. The costs for sending the returned Product by courier back to the sites of Convertika EOOD will be borne by the Users.

Once the Withdrawal Period has ended, no exchanges or returns of Products will be accepted. Replacements will only be accepted for Products that may have been defective under the provisions set forth in section b) below.

  1. b) Return or replacementof defective products

When the user believes that the product does not meet the specifications established for that product, he must contact Convertika EOOD immediately by sending an email to the contract address info@mrboho.bg, providing details of the product, as well as information about the defect and whether they prefer to return the product or exchange it for an identical product.

Users can return the Products by handing them over to their original place of delivery to a courier that Convertika EOOD will send or with their own funds. After the returned Product has been inspected, Convertika EOOD will send an email to the User within a reasonable period, telling them whether the return or exchange of the Product can proceed (“Return or Exchange Decision”). Where the decision is positive, the Product will be returned or replaced as quickly as possible and in any event within fourteen (14) calendar days of the date on which the Return or Replacement Decision is sent.

When the return or exchange takes effect, Convertika EOOD will fully refund the User the price paid for the Product, as well as the shipping costs. When the user has chosen to replace the product, Convertika EOOD will bear all the costs of the delivery of the product.

  1. c) Common provisions for returns

Users must comply with the following requirements in order to exercise their right of withdrawal and to be able to return or exchange the Products:

(i) For the purpose of arranging the return of the product to Convertika EOOD, users must complete all fields on the return form accompanying the delivered product;

(ii) Users may confirm that they exercise their right to opt out by any legally acceptable means; in any case, this right will be deemed validly exercised by returning the Product;

(iii) Products must be returned in the same condition in which they were received. Convertika EOOD will not refund any amount when the Product has been damaged, therefore Users should be careful with the Product while it is in their possession; and

Refunds will be made through the same payment method used by the User to pay for the Product.

 

Use of website

 

Users undertake to use the website in accordance with legislation, morality, generally accepted good manners and current public order. Users undertake to refrain from using the website for purposes that are illegal, contradict the provisions established in these Terms of Use, harm the rights or interests of Convertika EOOD or third parties, or that may harm or undermine in any way the image or reputation of Convertika EOOD or preventing the normal use or enjoyment of the products and services offered by Convertika EOOD on the website.

Intellectual Property

All information contained on the website, including its graphic design and source code, is protected by copyright and other rights and regulations governing intellectual property.

These rights belong exclusively to Convertika EOOD or its licensors, which is why it expressly prohibits any copying, distribution, transformation or public communication, as well as any kind of transfer, in whole or in part, of content from the website and, in general, any use in whole or partially of the content (images, texts, design, indexes, forms, etc.), as well as databases and software necessary for their display or functioning, as well as any other element that, according to current legislation, is protected under the provisions of intellectual property.

Users are not entitled under any circumstances to make commercial use of the content that makes up the website, directly or indirectly, except those provided by them, where appropriate, without the prior written permission of their owner. Permission to use any of the website’s content can be requested by sending an email to info@mrboho.bg. The provisions established in the preceding paragraphs do not in any case imply acceptance of responsibility or liability by Convertika EOOD for the content, nor can they create a right to compensation for Users or third parties.

Neither trademarks, trade names, shop signs, company names, logos, slogans or any other kind of distinguishing mark displayed on the website and belonging to Convertika EOOD, and in particular, the name of the company Convertika EOOD, may be used without prior written permission from Convertika EOOD.

Convertika EOOD expressly reserves the right to pursue as many civil cases and criminal prosecutions as it may be entitled to under Bulgarian and foreign law as a result of any violation of peaceful possession and/or unauthorized possession of industrial and intellectual property rights.

Technological limitations

We hereby inform the User that, in certain cases, temporary interruptions may occur in the Website, and therefore in the Services offered through it, as a result of maintenance activities.

We also inform the User that a large number of factors in addition to the points mentioned above may affect the website and/or its quality, which include but are not limited to: environmental conditions, network saturation, link and/or third party software.

Likewise, Convertika EOOD may cancel, restrict or block access to its website when technical difficulties arise from events or circumstances beyond the control of Convertika EOOD that, in its opinion, compromise or remove the security levels or standards adopted for the proper functioning of the website .

Responsibilities, liabilities and prohibited Uses

Users must refrain from using the Website to engage in any illegal activity. Users should refrain from using the Website in particular for the following non-exhaustive examples:

(i) impersonating other users or third parties;

(ii) Dishonesty in Transactions;

(iii) Falsification of data;

(iv) Any fraudulent conduct; and

(v) The user must not perform any activity that may harm a third party and/or Convertika EOOD and MR. BOHO Spain and the operation and/or development of the Website.

Under no circumstances is Convertika EOOD responsible for:

(i) Any loss, damage or harm of any kind arising from access to and use of the Website, including but not limited to where this occurs in IT systems or is caused by the introduction of a virus and/or cyberspace attacks.

(ii) Any damages that Users may suffer from improper use of the Website or for any computer crashes, interruptions or lack or failure of telecommunications.

(iii) The truthfulness, integrity or timeliness of information not collected by it.

(iv) For information that another source refers to or that is contained on other websites hyperlinked from the Website.

(v) For any temporary discrepancies that may occur between its printed documents and their electronic versions published on the Website.

(vi) For the sanctions incurred by Convertika EOOD, due to which the User has a refund on his card, according to the provisions established in Section 4.7 of these Terms of Use.

(vii) Damages, including but not limited to: damages, losses or expenses, direct or indirect, inherent or consequential, arising in connection with this website or its use or inability to use it by any party, or in connection with any failure in performance, error, omission, interruption, defect or delay in the transaction or transfer, computer virus or system or online crash.

Convertika EOOD acts as a service provider, therefore its obligations will not exceed its functions and is not responsible for any obstacles arising from banks or payment institutions, in which case it will mediate as much as possible.

Link to third parties

Convertika EOOD does not bear any responsibility for links that provide the User with access through the website to benefits and services offered by third parties, provided that they are external to the website. Therefore, Convertika EOOD bears no responsibility or liability for the information contained in these links or for any consequences that may arise from this information.

Data collection

Cookies are small data files that are located in the terminal of the user visiting the website and that contain certain information about the visit to this site.

Convertika EOOD reserves the right to revise these Terms of Use at any time for legal or technical reasons and for changes in the services offered by CONVERTIKA or for strategic decisions. In such cases, changes to the Website Terms of Use will be posted before they become effective. Users who do not agree to the changes should stop using the Website and terminate their user membership. Use of the website after notification of changes means that the user accepts those changes.

Contacts and communications in writing

 

The applicable regulations require that part of the information or messages that Convertika EOOD sends to Users must be in writing. By accepting these Terms of Use, the User accepts that most of the communication from Convertika EOOD will be electronic, contacting the User by email or by posting messages on the Website. The user agrees to use this electronic medium for communication and acknowledges that any notification and other messages that Convertika EOOD sends electronically and meet the legal requirements will be in writing.
